1. Overview

This website, frouge.us.com (the "Site"), is operated by Frouge LLC, a Florida limited liability company ("FROUGE", "we", "us", "our"). By visiting the Site or purchasing from us, you agree to these Terms of Service ("Terms"), together with our Privacy Policy, Shipping Policy and Refund Policy, which are part of these Terms. If you do not agree, please do not use the Site.

2. Eligibility

You must be at least 18 years old, or the age of majority where you live, to place an order. By ordering, you confirm that the information you provide is accurate and complete.

3. Products

Our products are cosmetic personal care products for external use only. Please read each product's ingredient list before use, perform a patch test if you have sensitive skin, and stop use if irritation occurs. Our products are not intended to diagnose, treat, cure or prevent any disease, and nothing on the Site is medical advice.

We make every effort to display products, colors and packaging accurately. Images are for illustration, and actual packaging may vary slightly.

4. Prices and availability

All prices are in U.S. dollars. Prices, products, promotions and availability may change at any time without notice. We may limit quantities and may discontinue any product. If a product is listed at an incorrect price or with incorrect information because of an error, we may cancel any order placed for that product and refund any amount charged.

5. Orders and payment

Your order is an offer to buy. An order is accepted when we ship it. We may refuse or cancel any order, including orders that appear to be placed by resellers or that we suspect are fraudulent; if we cancel after you have been charged, we will refund the charge. Payment is processed securely at checkout by our payment providers; we do not store full card details.

6. Promotions and discounts

Promotions, automatic discounts and discount codes are subject to their stated terms, cannot be exchanged for cash, and may be changed or ended at any time. Unless stated otherwise, discounts cannot be combined.

7. Shipping, returns and refunds

Shipping is governed by our Shipping Policy. Returns and refunds are governed by our Refund Policy, including our 30-Day Guarantee for damaged, defective or incorrect items. Title and risk of loss pass to you when the order is delivered to the carrier; we will still help resolve lost or damaged shipments as described in our Refund Policy.

8. Marketplace orders

Purchases of FROUGE products made through Amazon, TikTok Shop or other third-party marketplaces are governed by that marketplace's terms and policies.

9. Intellectual property

All content on the Site, including the FROUGE name and logo, product names, text, photographs, videos and design, is owned by or licensed to Frouge LLC and is protected by intellectual property laws. You may not copy, reproduce, modify, distribute or use it for commercial purposes without our written permission.

10. Reviews and submissions

If you submit a review, comment or other content, you confirm it is truthful and your own, and you grant us a non-exclusive, royalty-free license to use, reproduce and display it in connection with our business. We may remove content at our discretion.

11. Acceptable use

You agree not to use the Site for any unlawful purpose, to interfere with its security or operation, to upload malicious code, or to attempt to access accounts or data that are not yours.

12. Third-party links

The Site may link to third-party websites or services. We are not responsible for their content, products or practices.

13. Disclaimer of warranties

Except as expressly stated in our Refund Policy, the Site and our products are provided "as is" and "as available". To the fullest extent permitted by law, we disclaim all other warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. Individual results from using our products may vary.

14. Limitation of liability

To the fullest extent permitted by law, Frouge LLC and its owners, employees and partners will not be liable for any indirect, incidental, special or consequential damages arising from your use of the Site or our products. Our total liability for any claim relating to an order will not exceed the amount you paid for that order. Some jurisdictions do not allow these limitations, so they may not apply to you.

15. Indemnification

You agree to indemnify and hold harmless Frouge LLC from claims, losses and expenses (including reasonable attorneys' fees) arising from your breach of these Terms or your misuse of the Site.

16. Governing law

These Terms are governed by the laws of the State of Florida and applicable U.S. federal law, without regard to conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Florida, and you consent to their jurisdiction.

17. Changes to these Terms

We may update these Terms from time to time. Changes take effect when posted on this page, and the "Last updated" date above will change. Orders already placed are governed by the Terms in effect when the order was placed.

18. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
